This Privacy Policy explains how Fanswer Ltd ("we", "us", "our") collects, uses, shares, and protects your personal data when you use the Fanswer platform. It should be read alongside our Terms and Conditions.

By creating an account or using any part of the platform, you are agreeing to the practices described in this policy. If you do not agree, please do not use the platform.

2. Information We Collect

When you use Fanswer, we may collect the following types of information:

Account information, including your name, email address, username, and any other details you provide when you register.

Usage data, including your quiz participation, scores, streaks, raffle ticket activity, prize draw entries, timestamps, device information, and general analytics such as pages viewed and session duration.

Referral data, including information about users you have invited to the platform and their onboarding activity where relevant to your ticket earnings.

Communication data, including any messages or enquiries you send to our support team.

We do not collect or require sensitive financial information for quiz participation, raffle ticket earning, or prize draw entry.

Fan engagement and behavioural data, including your quiz answer patterns, topic preferences, knowledge depth, genre affinity, and engagement history. This data forms part of your Fan DNA profile and is used to personalise your experience on the platform and to help us and our artist and partner network connect you with content, campaigns, and offers relevant to your interests. This processing is carried out on the basis of our legitimate interests in providing a personalised fan engagement service.

3. How We Use Your Information

We use the information we collect to:

Operate and improve the platform and its features, including quizzes, streaks, raffle mechanics, and prize draws.

Administer raffle ticket allocation, track your earned tickets, and manage your prize draw entries and outcomes.

Contact you about platform updates, new campaigns, prize draw results, support requests, and other important notices.

Send you communications on behalf of commercial partners, in line with the preferences you have set and the opt-out rights described in our Terms and Conditions.

Monitor and prevent fraud, abuse, and violations of our Terms and Conditions.

Generate anonymised or aggregated analytics to understand how the platform is used and how we can improve it.

4. Legal Basis for Processing

Where applicable data protection law requires us to identify a legal basis for processing your data, we rely on one or more of the following:

Performance of a contract, meaning we need to process your data to provide you with access to the platform and its features.

Legitimate interests, including fraud prevention, platform security, service improvement, analytics, and Fan DNA behavioural profiling to personalise your experience and connect you with relevant content and partners, where those interests are not overridden by your rights.

Compliance with legal obligations that apply to us.

5. Data Sharing

We may share your data in the following circumstances.

With service providers who help us operate the platform, including hosting, analytics, email delivery, and security providers. These providers process data on our behalf under appropriate contractual safeguards and are not permitted to use your data for their own purposes.

With partners on the platform, including artists, promoters, festivals, venues, labels, brands, and other commercial partners, where you have given consent through the platform — either at the point of quiz completion or through your account settings.

With legal or regulatory authorities where we are required to do so by law, or where necessary to protect the rights, safety, or property of Fanswer, our users, or others.

Sharing your details with artists and partners following a quiz

When you complete a quiz associated with a featured artist or partner, we may ask whether you are happy for your details to be shared with them. The lawful basis for this processing is consent under UK GDPR Article 6(1)(a). Your consent is collected at the point of the quiz through a clear yes or no prompt. Consent is voluntary — saying no has no effect on your ability to use the platform. Where you say yes, we may share your name, email address, and quiz engagement data with that artist or partner at that time, or at a later point if a commercial relationship is formed after you played. You can withdraw your consent at any time by contacting us at support@fanswer.xyz or through your account settings. Withdrawal of consent will not affect the lawfulness of any sharing that took place before you withdrew.

In-platform messages from Fanswer and our partners

Fanswer operates an in-platform messaging system through which we may send you platform updates, new campaign announcements, prize draw alerts, and relevant offers. We may also send messages on behalf of artists and partners in our network. The lawful basis for Fanswer’s own messages is legitimate interests under UK GDPR Article 6(1)(f) — keeping you informed about activity directly relevant to your use of the platform. The lawful basis for partner messages sent through the system is consent under UK GDPR Article 6(1)(a) — we will only send you partner messages where you have given consent, either through the end-of-quiz prompt or through your account settings. You can manage all messaging preferences — including opting out of partner messages independently of Fanswer messages — at any time in your account settings. Opting out will never affect your ability to use the platform or earn and enter prize draws.

6. International Data Transfers

Fanswer Ltd is registered in England and Wales and operates globally. Your data may be processed and stored in countries outside your country of residence, including the United States. Where transfers of data outside the UK or European Economic Area take place, we ensure that appropriate safeguards are in place in line with applicable data protection law, such as standard contractual clauses or equivalent mechanisms.

7. Data Retention

We keep your data for as long as your account is active and for as long as necessary to provide the platform, meet our legal obligations, resolve disputes, and enforce our agreements. When your data is no longer needed for these purposes, we will securely delete or anonymise it.

If you request deletion of your account, we will action this promptly, subject to any legal obligations that require us to retain certain information for a defined period.

8. Your Rights

Depending on where you are based, you may have the following rights in relation to your personal data.

The right to access the personal data we hold about you.

The right to request correction of any inaccurate or incomplete data.

The right to request deletion of your data, subject to certain legal exceptions.

9. Security

We implement reasonable technical and organisational measures to protect your data against unauthorised access, loss, misuse, or disclosure. These measures are reviewed and updated regularly. While we take data security seriously and work hard to protect your information, no system can be guaranteed to be completely secure and we cannot accept liability for unauthorised access that is beyond our reasonable control.

10. Age Restrictions

Users are required to confirm they are 13 years of age or older when creating an account. We do not knowingly collect personal data from children under 13 without verifiable parental consent. If you believe a child under 13 has created an account without parental consent, please contact us at support@fanswer.xyz and we will promptly review and delete the account and associated data where appropriate.

Certain prize draws involving age-restricted prizes — including alcohol, adult experiences, or other age-restricted content — are restricted to participants aged 18 and over. Age verification is carried out at the point of prize draw entry for those draws, not at account creation. Where a user under 18 wins an 18+ prize draw, the prize will be issued to a nominated adult of their choice who completes identity verification. We collect personal data from all users regardless of age for the purposes of operating the platform.

11. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in how we operate or in applicable law. Where changes are material, we will notify you via the platform or by email. The updated policy will always show the revised date at the top. Continued use of the platform after an updated policy is posted means you accept the revised terms.
